OVERVIEW Welcome to the Dermastamp.hu webshop (hereinafter: "Webshop" or "Service")! The terms "we", "us" and "our" refer to the operator of the Webshop. The technical platform of the Webshop is provided by Shopify, which makes it possible to operate the online ordering interface. The contract of sale concluded in the Webshop, however, is concluded between the Customer and the Operator.

By visiting, browsing and using the Webshop, you accept these Terms of Service ("Terms") and the policies referred to below:

ACCESS AND USER ACCOUNT As a general rule, the Service may be used independently by a person who has reached the age of 18. When placing an order, you declare that the data provided (in particular the billing and shipping data) are true, accurate and complete, and that you are entitled to provide them.

If the Webshop also makes it possible to create an account, you are responsible for protecting your login data and for the activities carried out with your account. The account is not transferable.

PRODUCTS - NATURE, INFORMATION The products sold in the Webshop may include the single-use dermastamp, which is a medical device, in a non-sterile version. Before using the product, please read and follow the instructions for use (IFU).

The instructions for use are available online in several EU languages: https://dermastamp.hu/pages/ifu A paper-based Hungarian-language instruction for use is included in the product package.

The purpose of the product descriptions, images and information materials is to provide accurate information. The images may be illustrations; the appearance of the product (e.g. packaging, shade) may differ depending on the display settings. We reserve the right to modify product descriptions and to discontinue products.

USE OF THE PRODUCT AND LIABILITY The dermastamp sold in the Webshop is a medical device (Class I classification under EU MDR 2017/745). The device may be used solely in accordance with the enclosed instructions for use (IFU), at your own responsibility.

By ordering the product, the Customer acknowledges and accepts the following:

(a) The device may be applied solely in the manner described in the instructions for use, at the frequency specified and with the recommended needle depth. The Operator accepts no liability for consequences arising from use that departs from the instructions.

(b) The device may not be applied in the following cases: active acne, open wound, eczema, rosacea, psoriasis, active herpes, sunburn, irritated or inflamed skin surface, known metal allergy, or any skin condition that the instructions for use mark as a contraindication. If the Customer suffers from any of the listed conditions, they should not use the device and should consult a doctor if necessary.

(c) Before using the device, the Customer must make sure that their skin condition allows microneedling to be applied. In case of doubt, it is advisable to seek the opinion of a doctor or dermatologist.

(d) The results of microneedling are individual; the Operator does not guarantee any specific skin improvement result. The information materials, content and user testimonials appearing in the Webshop and on social media platforms are for information purposes only, reflect individual experiences, and do not constitute medical advice.

(e) The product is single-use: each needle head may be used on one single occasion only, its reuse is prohibited. The Operator accepts no liability for any risk of infection or injury arising from reuse.

(f) It is the Customer's responsibility to ensure appropriate hygiene before, during and after the treatment (cleaning of the skin surface, hand washing, appropriate handling of the needle head).

THE ORDERING PROCESS, CONCLUSION OF THE CONTRACT By placing the order you make an offer to purchase. The contract is concluded when we confirm the order by e-mail (confirmation e-mail).

We reserve the right to reject or cancel the order in justified cases (e.g. obvious pricing error, lack of stock, suspicion of abuse). In the case of rejection or cancellation we will refund the amount paid.

PRICES, PAYMENT, INVOICING The prices displayed in the Webshop are the prices in force at the time the order is placed. Shipping costs and any other fees are displayed during the checkout process.

You undertake to provide the data required for payment and invoicing accurately, and to update them if necessary. In the case of a failed or declined payment, the fulfilment of the order may fail.

SHIPPING, FULFILMENT, RISK OF DAMAGE Delivery times are indicative. We accept no liability for delays that occur due to the carrier or due to reasons beyond our control.

Risk of damage: in the case of a consumer sale, the risk of damage to the product typically passes to the Customer when the Customer (or the recipient designated by them) takes delivery of the product.

WITHDRAWAL, RETURN, REFUND The detailed rules of return and refund are set out in the Return and refund policy: https://dermastamp.hu/policies/refund-policy

Special note in the case of the dermastamp (hygienic nature): due to the nature of the single-use dermastamp, once the packaging has been opened the product cannot be returned for health protection/hygiene reasons, since it cannot be established with certainty that the product is untouched, unused and uncontaminated. The possibility of return/withdrawal therefore typically exists, in accordance with the policy above, in the case of unopened, intact packaging.

30-day money-back guarantee (voluntarily undertaken): for the dermastamp we undertake a 30-day money-back guarantee over and above the statutory right of withdrawal. If, after trying out the first stamp, the Customer decides within 30 days of receipt that the product is not for them after all, we will refund the purchase price of the whole package, without a return. KELLÉKSZAVATOSSÁG (STATUTORY WARRANTY FOR DEFECTS), TERMÉKSZAVATOSSÁG (PRODUCT WARRANTY AGAINST THE MANUFACTURER), JÓTÁLLÁS (GUARANTEE) In the case of defective performance, the Customer is entitled to the kellékszavatosság rights under the Polgári Törvénykönyv (the Hungarian Civil Code): they may primarily request repair or replacement, secondarily a price reduction, and as a last resort they may withdraw from the contract. In the case of a consumer contract, the kellékszavatosság claim may be enforced within two years of performance; in the case of a defect discovered within one year of performance, it must be presumed that the defect already existed at the time of performance.

Termékszavatosság: in the case of a defect in the product, the Customer may also enforce directly against the manufacturer their claim that the manufacturer repair the defect or replace the product, within two years of the product being placed on the market by the manufacturer. For the same defect, a kellékszavatosság claim and a termékszavatosság claim cannot be enforced at the same time, in parallel with each other.

Jótállás: the products sold in the Webshop are not covered by a mandatory jótállás based on legislation. The conditions of the voluntarily undertaken 30-day money-back guarantee are set out in the Return and refund policy; the guarantee does not affect the Customer's rights arising from legislation.

INTELLECTUAL PROPERTY The content of the Webshop (texts, images, graphics, logos, brand elements, layout, videos, etc.) is the intellectual property of Dermastamp.hu (Tóth Marcell Balázs egyéni vállalkozó) or its partners, or may be content used under licence. Copying, distributing or adapting the content without permission is prohibited.

THIRD-PARTY SERVICES, LINKS The Service may contain third-party services or links. We accept no liability for these (in particular for the content of third-party sites). You may use third-party services in accordance with their own terms.

DATA PROTECTION The processing of personal data is governed by the Privacy policy: https://dermastamp.hu/policies/privacy-policy

Shopify, as the technical platform, may process data for the provision and development of the service in accordance with its own data processing terms.

FEEDBACK, REVIEWS If you send an opinion, review or suggestion about the Webshop (e.g. by e-mail or on the interface), you acknowledge that we may use it for the operation and development of the Service and for marketing purposes, within the framework of the applicable legislation.

ERRORS, INACCURACIES We reserve the right to correct obvious errors (e.g. typing error, incorrect price). In the case of an obvious pricing error we are entitled to cancel the order and refund the amount paid.

PROHIBITED USE It is prohibited to use the Service in a way that is unlawful, infringes the rights of others, endangers the security of the system, is aimed at fraud, or hinders the intended operation of the Webshop.

LIMITATION OF LIABILITY We provide the Service on an "as available" basis. We accept no liability for indirect damage (e.g. lost profit) arising from the use of the Service, unless legislation provides otherwise.

These Terms do not limit the mandatory rights to which the consumer is entitled (e.g. kellékszavatosság, termékszavatosság).

TERMINATION / RESTRICTION OF THE SERVICE In the case of abuse or a serious breach of the Terms, we are entitled to restrict or terminate the use of the Service, or to refuse the order.

GOVERNING LAW, COMPLAINT HANDLING, DISPUTE RESOLUTION These Terms are governed by Hungarian law.

In the case of a consumer dispute, the consumer is entitled to turn to the békéltető testület (Hungarian conciliation board) competent according to their domicile or place of residence, or according to the registered address of the business. The business has an obligation to cooperate in the conciliation board procedure.

PONT KLUB LOYALTY PROGRAMME The Webshop operates its own loyalty programme (hereinafter: "Pont Klub"). Participation is voluntary and free of charge, and is tied to a customer account. This chapter sets out the legal framework of the programme; the collection rates, redemption options and detailed operating rules of the programme in force at any given time are available on the following page: https://dermastamp.hu/pages/pont

The nature and use of the point (pont): after purchases and the activities specified in the programme we credit points (hereinafter: "pont"). The pont can be redeemed on the point shop interface of the Webshop for the products displayed there, at the pont prices stated there. For a customer with a subscription, the redeemed product is delivered with the next subscription package; without a subscription, the redeemed product is delivered with the customer's next order, without a separate shipping fee. The pont is not a means of payment, cannot be exchanged for cash, does not bear interest, cannot be transferred to anyone else, and can be used solely in the Webshop.

Expiry and value protection: credited pont does not lapse, and we do not subsequently reduce an already credited pont balance. We may modify the future rules of the programme (in particular the collection rates and the redemption options) with effect for the future; the modification does not affect the balance already credited. In the event that the programme is closed, we provide at least 12 months from the announcement of the closure for the use of pont already credited.

Refund: if an order is refunded in part or in full, the pont credited for the order is deducted from the balance in proportion to the amount refunded.

Referral programme: members of the programme may have a personal referral code. The referral code is at the same time a discount code, which a new customer may use on their first order under the conditions stated on the programme page; the referrer is entitled to a reward after the first paid order placed with the code. Self-referral, as well as collecting rewards contrary to their purpose (in particular the use of fictitious accounts or fictitious orders), is excluded.

Abuse: in the event of manipulation of the programme, the Operator is entitled to cancel the credits concerned and, in serious cases, to terminate participation in the programme. We will inform the customer concerned about the measure.

MODIFICATION OF THE TERMS We reserve the right to modify the Terms. Modifications enter into force upon publication in the Webshop. The version current at the time the order is placed is always the governing one.

RELATIONSHIP WITH SHOPIFY The Webshop is operated by Shopify as a technical platform, which makes it possible to provide the Service. At the same time, the purchases you carry out in the Webshop are concluded directly between the Customer and the Operator. Shopify is not responsible for the fulfilment of the sale between the Operator and the Customer, or for claims arising from it; please raise questions and complaints relating to the purchase with the Operator at the contact details above.
